Who can sell on this marketplace?

imayde LLC welcomes makers, artists, photographers, and crafters who create original works. All products must be handmade, hand-altered, or personally designed by the seller. No mass-imported, drop-shipped, or factory-produced items are permitted.

What is the criteria for selling?

A seller must:

  • Create original works – No drop-shipping, mass-importing, or reselling.
  • Have a process that is primarily handmade, hand-altered, or personally designed
    (but not handed over to a factory after designing it).
  • Be based in the United States.
  • Be able to provide details on materials and methods.
  • Submit listings that are honest in photography and description
  • Attest that all works are of their own creation.
  • Commit to imayde LLC's Supplier Code of Conduct.

What happens if a seller is not adhering to imayde's criteria and requirements?

All sellers agree to imayde's Terms and Conditions and Supplier Code of Conduct when creating an account and listing work on imayde. Sellers who are believed to be in violation of these terms will first be contacted by the imayde management team in an attempt to resolve the issue. Sellers may be asked to provide information that verifies their creation process.

If the issue cannot be resolved, the seller may be banned from the marketplace. Note that in some cases listings believed to be in violation may be temporarily made inactive while the issue is investigated. Individuals who believe a seller or listing is in violation of the Terms and Conditions may email the imayde LLC management team at imaydemarketplace@gmail.com to report any concerns.

Are there any location requirements for sellers?

All sellers must be based in the United States, and all products must ship from the United States. International sellers and shipments are currently not accepted.

Are there any product category restrictions?

imayde LLC focuses on physical goods and certain digital downloads that meet its originality and authenticity standards. Some product types, such as original photography, have additional rules.

What are the special requirements for photography listings?

  • Digital downloads: Sellers may sell digital downloads of original photographs that they own 100% copyright to.
  • Delivery method: Files must be delivered using the seller's own platform, file transfer service, email, or website. imayde LLC does not host or deliver digital downloads at this time. Delivery method and timing must be noted in the listing description.
  • Editing: Reasonable photo editing is allowed (cropping, contrast, retouching, reasonable use of AI editing features, etc.), but the final image must still be the seller's original photography.
  • Fully AI-generated images: Not permitted.

Are prints of photographs permitted?

Printed versions of original photographs may be sold and shipped as a physical product.

Are other types of digital downloads allowed?

Original patterns, printables, and tooling files are permitted providing they comply with all Terms and Conditions and are the seller's original work.

What counts as “original” work?

The work must be created or significantly altered by the seller. That includes handmade, hand-altered, or personally designed pieces. Fully outsourced or mass-produced products are not permitted.

Do sellers keep the rights to their work?

Sellers retain full rights to and ownership of their work.

What is imayde LLC's policy on AI-generated products?

Fully AI-generated images are not permitted. However, artists are permitted to use AI as part of their creative process when creating physical items, just as they might use any other resource.

How does imayde LLC enforce its policy on AI-generated products?

imayde LLC's AI policy is enforced through routine reviews of listings by the imayde management team. Concerns regarding improper use of AI may be reported via email to imaydemarketplace@gmail.com.

Are food products permitted?

No. Food, beverages, alcohol, baked goods, and other edible products are not permitted.

How are orders shipped?

Sellers are responsible for packing and shipping orders directly to customers. Shipping insurance is required.

How do sellers get paid?

Payments are processed through a secure 3rd party provider. Funds are released once the order is marked as shipped, following any holding period.

How long do sellers have to ship an order?

Reliable and prompt shipping is expected. Orders should not go more than a week without shipment. Sellers who are away and unable to ship product within a week's time (such as out on vacation, etc.) should close their listings while they are out. Listings can be reopened with a click of a button.

Note that custom orders may take longer to ship as the time to create the item must be factored in. Sellers should be upfront about estimated timelines and clearly communicate them to the buyer.

Can sellers offer custom orders?

Yes, as long as the finished product meets our originality rules. Sellers should be clear about timelines and customization options.

What happens if there’s a dispute?

Purchases can be disputed by the buyer after a transaction is marked delivered and before it is marked received.

Disputed transactions can then be cancelled by the seller. Disputed transactions are also cancelled automatically by the system 60 days after the transaction is disputed, if no other action takes place. When a transaction is cancelled, a full refund is issued to the customer.

Transactions can also be cancelled by the seller after the customer makes the purchase and before any other steps, such as marking the transaction received or delivered, are taken. Transactions will automatically cancel after 14 days if no other steps are taken by the seller or customer after the purchase.

Sellers and buyers should first attempt to resolve minor issues using imayde's messaging system. If a resolution cannot be reached, imayde LLC will work to help resolve disputes between buyers and sellers fairly.

What happens if a product is damaged during shipping?

Items should be shipped with shipping insurance. Most carriers provide shipping insurance up to a certain dollar amount. If the item is worth more than the carrier's standard dollar value, additional insurance should be purchased to cover the full purchase price.

If a product is received damaged, the buyer should report the damage quickly. The buyer should dispute the transaction rather than mark it as received. This should be done as soon as possible after delivery. The buyer should take clear photos of the damaged item and its packaging.

Note that items are automatically marked as received 14 days after delivery. Once an item is marked as received, the item is no longer eligible for a refund.

Once a buyer initiates a dispute, the seller should open a claim with the shipping company. The buyer must hold on to the item, the box, and all packing materials until the claim is resolved. Carriers often require proof of packaging to honor an insurance claim. Buyers are required to cooperate with the claims process, including bringing the damaged item to the carrier if requested, in order to receive a refund. Refunds or replacements may be denied if a buyer refuses to participate in the required insurance claim process.

How does imayde handle intellectual property and copyright infringement?

imayde LLC fully complies with all applicable U.S. laws regarding copyright and intellectual property via a reporting and takedown process. imayde LLC does not approve or support unauthorized use of trademarks, including counterfeit or confusingly similar marks. imayde LLC acts quickly to investigate and resolve reported trademark violations.

If a listing appears to infringe on copyright or IP rights, the imayde management should be contacted through email at imaydemarketplace@gmail.com. The email must include identification of the protected work (copyright or trademark), listing details or a URL to locate the content, and any evidence or explanation of how it infringes. For formal DMCA requirements, reference section 6.4 - Intellectual Property of Others and Copyright Infringement in our Terms of Service.

imayde LLC promptly reviews the claim and removes or disables access to any content which appears infringing. Sellers are notified by the imayde management team via email when their listing is removed and may contact imayde if they believe the decision to remove the listing was made in error.

In addition to responding to formal copyright or trademark reports, imayde LLC reserves the right, at its sole discretion, to remove or disable access to any listing or content that it believes may infringe on another party’s intellectual property or otherwise violate these Terms — even if no formal complaint has been received. This helps ensure that the imayde marketplace remains fair, lawful, and respectful of creators’ rights.

imayde LLC maintains a strict repeat-infringer policy. Persistent offenders will have their accounts permanently deleted.

Sellers on imayde LLC are legally responsible for all listed content, including ensuring that listings do not infringe on copyrights, trademarks, or other IP rights.
